6. Statement about data collected by third party applications
6.1 Customer Liability and Bmotik's Disclaimer
The Client (event organizer or user of the Bmotik platform(s)) acknowledges and agrees that, by using the data collection functionalities offered by Bmotik (including, but not limited to: registration platforms, lead scanning applications or information exchange between participants and/or sponsors), he/she is solely responsible for the processing of personal data obtained through such tools.
The Customer represents and warrants that:
- Obtain the prior, informed and express consent of end users (e.g. event attendees) for the collection, use and transfer of their personal data (first name, last name, email, telephone, profession, company, address, city, country, or other) to third parties (e.g. Sponsors or other participants).
- Comply with all applicable data protection and data privacy laws (e.g. GDPR, LGPD, CCPA or local regulations).
Accordingly, the Client releases and holds harmless Bmotik, its affiliates and representatives, from any claim, demand, penalty or liability arising from the failure of the Client (or its clients, as sponsors) to treat the data collected through Bmotik's platforms.
6.2 Bmotik's Limitation of Liability
Bmotik acts as a mere technological supplier and:
- It will not use the personal data of end users for purposes other than those strictly necessary for the operation of its platforms (e.g. registration management, lead scanning or services contracted by the Customer).
- It shall not be liable for the use, storage, transfer or processing that the Client or its third parties (e.g. Sponsors or other participants) make of the data collected, nor for any failure to comply with its legal obligations.
6.3 Customer Obligations to Third Parties
The Customer shall ensure that any third party accessing the data (other attendees, suppliers, sponsors, exhibitors, etc.):
- Respect the limits of consent given by end users.
- Implement adequate security measures for data protection and habeas data.
- Refrain from using the information for unauthorized purposes (e.g., spam, data resale).
